Terms and Conditions

1.         Introduction

1.1       This Prize Draw Competition (Prize Draw) is organised by the University of Chester, a non-exempt charity registered in the United Kingdom with registered charity number 525938 of University of Chester, Grosvenor House, Parkgate Road, Chester, CH1 4BJ (University).

1.2       Subject to clause 1.3 below, you will be automatically entered into a Prize Draw when you register to attend one of the following open days:

October Open Days

Chester – 16th October 2021

Warrington – 23rd October 2021

Shrewsbury – 23rd October 2021

November Open Days

Chester – 13th November 2021

Shrewsbury – 18th November 2021

1.3       Confirmed registrants to one of the October Open Days referred to in clause 1.2 above will be automatically entered into the October Prize Draw. Confirmed registrants to one of the November Open Days referred to in clause 1.2 above will be automatically entered into the November Prize Draw. For the avoidance of any doubt, registrants registered to one of the October Open Days will not be entered into the November Prize Draw and vice-versa.

1.4       For the purposes of these Terms and Conditions:

(a)       the October Open Days and the November Open Days shall collectively be referred to as the Open Days; and

(b)       any reference to Prize Draw in these terms and conditions shall apply equally to the October Prize Draw and the November Prize Draw.

1.3       The following terms and conditions will apply to your entry into the Prize Draw. If you do not agree with these Terms and Conditions and/or do not wish to be entered into the Prize Draw, you can opt out of the Prize Draw by contacting visitus@chester.ac.uk. By not opting out of the Prize Draw, you confirm your acceptance to be bound by these Terms and Conditions. Please retain a copy for your information.

 

2.         Eligibility

2.1       Subject to clauses 1.2 and 1.3 above, the Prize Draw is open to everyone.

2.2       No purchase is necessary and there is no charge to register for any of the Open Days. Internet access is required.

2.3       There is a maximum of one entry per registrant for each Prize Draw irrespective of the number of Open Days you are registered to attend. The winner of the October Prize Draw will not be eligible for entry into the November Prize Draw.

2.4       Bulk entries will not be accepted.

 

3.         The October Prize Draw

3.1       The entry period for the October Prize Draw will run from 00:00 on 1st September 2021 until 12:00 (midday) on 7th October 2021 (GMT) (October Prize Draw Closing Date).

3.2       To enter the October Prize Draw you must register to attend one of the October Open Days specified in clause 1.2 before the October Prize Draw Closing Date. You can register to attend one of these October Open Days via our website https://www1.chester.ac.uk/open-days or by following this link.

3.3       Registrations to attend an October Open Day received by the University after the October Prize Draw Closing Date will not be entered into the October Prize Draw.

3.4       The University will not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems satellite, network server, computer hardware or software failure of any kind.

3.5       One winner will be selected by random draw performed by a computer process after 12:00 (midday) on 7th October 2021 (October Draw Date) and the winner will be notified via the email address and/or phone number provided on registration the same say. The winner must claim their Prize by 23:59 on 8th October 2021. If the winner does not claim their Prize by then, , the winner’s Prize will be forfeited and the University will be entitled to select another winner in accordance with the process described above.

3.6       The decision of the University regarding any aspect of the October Prize Draw is final and binding and no correspondence will be entered into about it.

3.7       The University reserves the right to cancel the October Prize Draw at any time for any reason.

 

4.         The November Prize Draw

4.1       The entry period for the November Prize Draw will run from 00:00 on 1st September 2021 until 12:00 (midday) on 4th November 2021 (GMT) (November Prize Draw Closing Date).

4.2       To enter the November Prize Draw you must register to attend one of the November Open Days specified in clause 1.2 before the November Prize Draw Closing Date. You can register to attend one of the November Open Days via our website https://www1.chester.ac.uk/open-days or by following this link.

4.3       Registrations to attend a November Open Day received by the University after the November Prize Draw Closing Date will not be entered into the November Prize Draw.

4.4       The University will not accept responsibility for entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems satellite, network server, computer hardware or software failure of any kind.

 4.5      One winner will be selected by random draw performed by a computer process after 12:00 (midday) on 4th November 2021 (November Draw Date) and the winner will be notified via the email address and/or phone number provided on registration the same day. The winner must claim their Prize by 23:59 on 5th November 2021. If the winner does not claim their Prize by then, the winner’s Prize will be forfeited and the University will be entitled to select another winner in accordance with the process described above.

4.6       The decision of the University regarding any aspect of the November Prize Draw is final and binding and no correspondence will be entered into about it.

4.7       The University reserves the right to cancel the November Prize Draw at any time for any reason.

 

5.         Prize Details

5.1       October Prize Draw

(a)       the winner will win a weekend in Chester, Warrington or Shrewsbury. This includes cost of travel, accommodation, a meal and a visit to a local attraction in one of the destinations listed in clause 5.1 (b) below for up to four people, up to a total value of £1,000.00.

(b)       the Prize must be spent in one of the destinations listed below and taken during the following dates:

  • for a weekend in Chester – during the Open Day weekend commencing 15th October 2021 to 17th October 2021; or
  • for a weekend in Shrewsbury – during the Open Day weekend commencing 22nd October 2021 to 24th October 2021; or
  • for a weekend in Warrington – during the Open Day weekend commencing 22nd October 2021 to 24th October 2021.

(c)       the winner must be available to use the Prize on the date(s) specified in clause 5.1(b) above. Subject to clause 5.11, no alternative dates will be available, and the Prize will be deemed forfeited if not used by the dates specified above.

(d)       the winner must attend the Open Day held by the University in the selected destination.

(e)       Winners under the age of 18 must be accompanied by an adult.

5.2       November Prize Draw

(a)       the winner will win a weekend in Chester or Shrewsbury. This includes cost of travel, accommodation, a meal and a visit to a local attraction in one of the destinations listed in clause 5.2(b) below for up to four people, up to a total value of £1,000.00.

(b)       the Prize must be spent in one of the destinations listed below and taken during the following dates:

  • for a weekend in Chester – during the Open Day weekend commencing 12th November 2021 to 14th October 2021; or
  • for a weekend in Shrewsbury – during the Open Day weekend commencing 17th November 2021 until 19th November 2021.

(c)       the winner must be available to use the Prize on the date(s) specified in clause 5.2(b) above. Subject to clause 5.11, no alternative dates will be available, and the Prize will be deemed forfeited if not used by the dates specified above.

(d)       the winner must attend the Open Day held by the University in the selected destination.

(e)       Winners under the age of 18 must be accompanied by an adult.

5.3       Unless otherwise agreed between the University and a winner, the Prizes will be booked on behalf of the winner of each Prize Draw by the University. The University will endeavour to work with the winner of each Prize Draw to make the most of their weekend and tailor their activities to suit their interests but entrants accept that all Prize elements may be subject to max. capacity, availability, convenience and any government guidelines that might be applicable. Third party terms and conditions to specific venues and transport may also apply. Any Prize elements relating to travel and/or accommodation must be taken up during one period, and not on non-consecutive dates.

5.4       Where any Prize element relates to travel for more than one person, the winner and their companion(s) must travel together, departing from and returning to the same location at the same time and on the same itinerary. The University cannot guarantee that seats will be adjacent to each other.

5.5       The Prize excludes all other costs and arrangements not expressly included in the Prize. Additional charges and expenses incurred for goods, services, attractions, facilities, upgrades, activities and events not expressly included in the Prize or which exceeds the £1,000 Prize allowance shall be the winner’s (and where applicable their companion(s)) responsibility and the University will accept no responsibility where the winner is unable to pay in full any such charges and/or expenses.

5.6       The Prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink (other than a meal), spending money or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the Prize are also the responsibility of the winner (and where applicable, their companion(s)).

5.7       Any and all costs incurred by obtaining time off from work or study to take part in the Prize Draw or Prize are the responsibility of the winner (and where applicable their companion(s)). The University accepts no responsibility for any costs incurred.

5.8       No refunds, cash difference or other compensation will be offered or provided if the full £1,000 Prize allocation is not used by the winner in accordance with these terms and conditions. No compensation will be offered in lieu of any Prize element where the winner does not use the Prize or any element of it within the deadline stipulated within these terms and conditions.

5.9       The Prize(s) must be accepted as awarded. No cash equivalent or alternative prize will be given at the request of the winner and the Prize is non-transferrable and non-exchangeable. No onward sale of any Prize element is permitted.

5.10    If due to circumstances beyond the University’s control, it is unable to provide the stated Prize(s), the University reserves the right to award a substitute Prize(s) of equal or greater value.

5.11    In the event that government restrictions and guidelines related to the Covid-19 pandemic prohibit the winner from realising the Prize on the confirmed date(s), the University will use its reasonable endeavours to re-arrange the Prize for an alternative date.

 

6          Limitation of Liability

6.1       Insofar as permitted by law, the University will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize.

6.2       The University’s use of particular brands or organisations does not imply any affiliation with or endorsement of such brands or organisations.

6.3       The University cannot promise that the services relating to the Prize Draw will be free from errors or omissions nor that it will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of any problem with any network or line, system server, software or for any technical malfunction or failure, maintenance or repair or for reasons reasonably beyond the control of the University. The University does not accept responsibility where all or part of the services relating to the Prize Draw is discontinued, modified or changed in any way.

6.4       The University does not accept any responsibility if a registrant is not able to take up the Prize.

 

7.         General

7.1       The Prize winners may be required to take part in related publicity and such participation is a condition of accepting a Prize.

7.2       The University reserves the right to refuse entry, or refuse to award a Prize to anyone in breach of these terms and conditions or where a registrant is unable to provide the University with satisfactory evidence of their compliance with these terms when reasonably requested.

7.3       The University reserves the right to hold void, cancel, suspend or amend the Prize Draw where it becomes necessary to do so, without liability to any registrant, winner or third party.

7.4      Personal data supplied during the course of this Prize Draw will only be processed for the purposes of the Prize Draw and in accordance with the University’s Privacy Policy.

7.5       If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

7.6       The Prize Draw and these Terms and Conditions shall be governed by English law and the courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with the Prize Draw.

7.7       Entries not complying with these terms and conditions will be invalid and will not be accepted.
