University of Chester terms of use for your social media photo

If you were directed here, it is because your social media photo caught our eye and we would love to share it with other people interested in the UNIVERSITY OF CHESTER. To do so, the UNIVERSITY OF CHESTER needs your consent to use the photo and any personal data that may be contained in it.

If you respond to our message with “#YESChester” you represent and warrant that:

  • you are at least eighteen (18) years of age or older;
  • you took the photo and you own all rights in and to your photo;
  • all of the people appearing in your photo are at least eighteen (18) years of age or older and have given you their consent to using the photo and to granting us the rights set out in the terms of use set out below;
  • our use of your photo does not infringe the rights of any third party or violate any law; and
  • you have read the terms of use set out below and agree to them.

(Your Declaration)

By responding to our message with #YESChester you also acknowledge that the UNIVERSITY OF CHESTER will rely on Your Declaration in good faith and as justification for the lawful use of your photo in accordance with these terms of use.

If at any time it becomes apparent that Your Declaration is inaccurate, misleading or false, and without limiting any other rights or remedies of the UNIVERSITY OF CHESTER, you shall indemnify (and hold harmless) the UNIVERSITY OF CHESTER against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) suffered or incurred by the UNIVERSITY OF CHESTER (howsoever incurred or arising) as a result of your false, misleading or inaccurate Declaration.

Please do not respond to our message with #YESChester unless you are able to verify that all of the above conditions are satisfied.

What happens if I respond with #YESChester?

By responding #YESChester you grant the UNIVERSITY OF CHESTER, an unlimited, non-exclusive, assignable, sub-licensable, perpetual and worldwide right to use the photo that you post or have posted with a YESChester hashtag or location tag. This means that the UNIVERSITY OF CHESTER will be entitled (but not obliged) to use your photo in any way and for any purpose, including to save, store, copy, reproduce, publish, post, transmit, distribute, display, share, modify, incorporate into other materials and in any way commercially exploit it. These usages include using your photo on UNIVERSITY OF CHESTER websites, e-newsletters, videos and other electronic marketing materials, mobile apps, postings on UNIVERSITY OF CHESTER social media accounts, or the use on websites of our partners. It may also comprise use in printed publications, such as our prospectuses, brochures, posters and banners.

Please note however that:

  • you will not receive any payment for any use we may make of your photo and by responding #YESChester you expressly waive your right to receive any payment for any use we may make of your photo;
  • we have no obligation to use your photo - whether or not we actually use your photo is entirely at our discretion;
  • we will not use your photo in any manner not contemplated by these terms of use without seeking your prior written consent; and
  • we will always respect your moral rights in your photo.

Please do not respond to our message with #YESChester if you do not wish to become subject to these terms of use.

What if I change my mind?

You may revoke the rights you grant to us under these terms of use at any time in one of the following ways:

  1. by setting your social media profile to “private”, or setting the specific photo at issue to “private”.
  2. by removing the photo from the relevant website/social network;
  3. by activating the opt-out tool available at https://www.olapic.com/trust;
  4. by sending an email to enquiries@chester.ac.uk and specifying your user name and a link to the image(s) you wish to revoke the rights to;
  5. for photos used on the University of Chester website you may click on the “report a photo” icon and promptly request the removal;

In such circumstances we will use our reasonable endeavours to stop using your photo as soon as practicable after receiving your request. Please note that due to the nature of printed materials, it will not be possible to recall photos used in print, however, we will refrain from using your photo in future publications.

Our Liability to You

To the maximum extent permitted by law, the UNIVERSITY OF CHESTER will in no way be liable to you for any:

  1. direct, special indirect, incidental, consequential or pure economic loss, costs, damages, charges or expenses; or
  2. loss of profits; or
  3. loss of business, contracts, goodwill, reputation or opportunity and/or similar loss; or
  4. loss of income, loss of anticipated savings, loss of goods, loss of use or loss of corruption of data or information;

howsoever arising or suffered by you as a result of our use of your photo in accordance with these terms of use even if such loss or damage was reasonably foreseeable or might reasonably have been contemplated by us and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.

Nothing in these terms of use excludes or limits the UNIVERSITY OF CHESTER’s liability for fraud or any liability to the extent that the same may not be excluded or limited as a matter of law.

Please note: all references to "University of Chester", "we". "us" and "our" in these Terms of Use means the University of Chester, Chester Conferences Ltd and all partner institutions.
